Andrej Babiš, the self-proclaimed tycoon who secured victory in last month's Czech election, has refused to offload his vast business interests, while asserting he will resolve a ethical dilemma that might block him from assuming the role of prime minister.

Position on Business Holdings

Babiš, whose political movement emerged victorious in the autumn election but lacked a parliamentary majority, declared in a social media post that he would not sell his Agrofert conglomerate, which operates in farming, food processing, and chemical industries.

“I have consistently said I will not sell Agrofert. I have consistently stated I will address the ethical issue in compliance with Czech and European laws,” the billionaire commented. “This is not like selling a pastry in a bakeshop.”

Head of State's Requirement

The Czech president, Petr Pavel, announced that the 71-year-old political figure must publicly explain how he will eliminate ethical conflicts stemming from his corporate dealings before being appointed prime minister.

The Czech constitution “explicitly requires the president to take into account the possible emergence of a ethical issue and the ways to address it” when selecting government ministers, Pavel's office noted.

The head of state “wants it to be clear in what specific way Andrej Babiš will fulfil his constitutional and legal obligations”, the statement said, noting that Pavel was prepared to appoint Babiš as premier “without delay” once the matter was resolved.

Business Operations and Legal Issues

Babiš's several hundred companies, primarily under the Agrofert group, function in the Czech Republic and other central European countries, benefiting from substantial funds in domestic and European agricultural and other subsidies, as well as public contracts.

Under national legislation, cabinet members are barred from obtaining public aid or agreements. The anti-corruption organization Transparency International has indicated that to prevent a conflict of interest, Babiš must either sell, refuse government deals, or stay out of government.

Previous Tenure and Current Intentions

Babiš affirmed he would “abide by the regulations” if selected as prime minister, but declined to explain how in beforehand because the matter was “an highly personal and personal matter for me, and the media will always criticise me regardless”.

During his first term as premier, from 2017 to 2021, Babiš faced multiple court cases and an European inquiry over possible conflicts of interest. He placed his assets into fiduciary arrangements, while keeping some influence over them.

A judicial body and the European Commission both determined that this did not suffice. Babiš stated recently that he was again the sole owner of Agrofert and maintained he was “implementing measures” to prevent a conflict of interest, but refused to reveal specifics.

Coalition Agreement and International Implications

The billionaire populist has signed a coalition agreement with two minor right-leaning groups, the ultra-conservative, Russia-friendly SPD, which has advocated a public vote on leaving the EU, and the Motorists for Themselves, which has mainly campaigned against the EU’s Green Deal.

The new government, if approved, is expected to strengthen the populist movement in central and eastern Europe and could challenge western support for Ukraine – although Babiš has called Ukraine’s president, Volodymyr Zelenskyy, to confirm of the nation's backing.

Pavel, who as head of state shares responsibility for foreign policy, also demanded that the coalition’s programme add a statement on the official stance on the conflict in Ukraine, with a pledge to meeting alliance duties.

The president has earlier said he would not approve any ministerial nominees who might doubt the Czech Republic’s EU and Nato commitments, a condition that the far-right SPD has indicated it will meet by proposing non-partisan experts.
