Federal Judge Orders Freedom of Kilmar Abrego Garcia from Immigration Detention
A court has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement is without lawful basis.
"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been re-detained, again without lawful authority," the judge stated in her ruling.
The case stems from a mistaken deportation to El Salvador earlier this year, which the government later admitted was an error. Following his repatriation to the United States to answer human smuggling allegations, he was held in federal detention.
In her order, the judge noted that the government does not have a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
Context of the Legal Challenge
The legal challenge center on disputed assertions. While the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this claim.
He has also entered a not guilty plea to the smuggling counts, which are part of a ongoing criminal case in Tennessee.
Terms of Release
The court, who was hearing his petition to deportation in a federal court, ruled that he must now adhere to the terms of his bond from custody in Tennessee. This order effectively transfers his supervision to the jurisdiction handling his criminal case.
This decision represents a significant turn in a complicated legal case involving claims of wrongful detention and contested gang associations.
